1. Introduction and Definitions

These Terms and Conditions (Terms) govern your use of the services provided by BigBoxPlay (BigBoxPlay, we, us or our), which include our digital game distribution platform, associated websites, software, and mobile applications (collectively, the Service).

By accessing or using our Service, you acknowledge and agree to be bound by these Terms. If you are under 18 years old and do not understand them, you must seek guidance from a parent or guardian.

These Terms may be updated periodically and become effective immediately upon publication on www.BigBoxPlay.com/terms-and-conditions. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Rights of Use and Intellectual Property

You are granted a limited, personal, non-transferable, and non-exclusive license to access and use the Service for your private, non-commercial use. This license includes the temporary downloading and installation of necessary files solely in connection with your legitimate use of the Service.

You may not:

• Copy, distribute, sublicense, or otherwise transfer any rights in the Service;
• Create derivative works based on the Service;
• Interfere with or disrupt the Service;
• Use any part of the Service for unlawful, immoral, or unauthorized purposes.

All content, software, design, trademarks, and intellectual property in the Service belong to BigBoxPlay or its licensors and are protected under applicable laws. Third-party trademarks are the property of their respective owners.

3. Restrictions and Conduct

You agree not to:

• Hack, reverse engineer, decompile or modify the Service;
• Circumvent geolocation or DRM restrictions using VPNs, proxies, or similar tools;
• Use or process the Service unfairly, fraudulently, or unlawfully;
• Upload or transmit content that infringes intellectual property rights or is otherwise harmful.

BigBoxPlay may monitor your use of the Service and take technical or legal measures to enforce these restrictions.

4. Purchases and Orders

You may purchase Products, including Games and Gift Cards, through the Service. The order process allows you to review and correct any errors before placing an order (Order).

• An Order is an offer to buy. A binding contract forms when we deliver the Product or confirm availability.
• If we are unable to fulfill an Order, we will inform you and refund any amount paid.
• Products may differ in availability or version depending on the point of payment confirmation.
• Use of a VPN or proxy may disrupt the download or activation of Products.

5. Price and Payment

Payment is required upon Order placement. Payment methods are shown at checkout and may include credit/debit cards, PayPal, or localized alternatives. Your payment provider may charge currency conversion or other fees.

We aim to process payments within three business days. If a payment is unsuccessful or reversed, we may cancel the Order and restrict access to the Product.

We do not guarantee price-matching or refunds after subsequent price changes.

6. Delivery and Activation

Delivery of Games may be by activation code, direct download, or access via a linked platform (e.g., Steam, Origin). The Product is considered delivered once access or a key is issued.

You must redeem activation keys within the specified period, and some codes may be region-locked.

7. Right to Cancel (EU Consumers)

If you are a consumer in the European Union, you may withdraw from your purchase within 14 days from the purchase date (the Cooling-Off Period) unless:

• you agreed to immediate delivery and acknowledged the loss of your withdrawal right; or
• the Product has been activated, downloaded, or the key disclosed.

To cancel within the Cooling-Off Period, contact support@BigBoxPlay.com. We will refund the purchase price within 14 days of your valid withdrawal request.

8. Refund Policy

Refunds may be issued at our discretion under the following conditions:

• The request is submitted within 7 days of purchase
• The Game has not been activated, downloaded, or disclosed (including bonus content)
• The game activation key (including any bonus or beta keys) has not been disclosed to you by email or web page
• The Game has not been pre-loaded or released within 48 hours of the refund request

We do not refund:

• Within 48 hours before a Game is due to be released or preload begins
• Purchases made using proxies or VPNs
• Incompatibility with your hardware/software
• Buyer’s remorse

PayPal refunds may be limited to 120 days after purchase.

9. Errors and Availability

We strive for accuracy, but errors in pricing or content may occur. We may cancel Orders affected by errors and issue a refund. We may also change or withdraw Products without notice.

10. Gift Cards and Promotions

Gift Cards:

• are redeemable for Products only on the Service;
• expire two years from issuance;
• cannot be transferred, resold, or redeemed for cash.

Promotions and Vouchers:

• may be restricted to selected Products or platforms;
• may expire or be withdrawn without prior notice;
• are valid once per customer unless otherwise stated.

11. Game Gifting and Codes

We may partner with third parties to offer redeemable digital gifts. Game Gift Codes:

• must be redeemed within two years of issuance;
• are subject to additional terms from the issuing partner.

12. Liability and Disclaimers

We are responsible for foreseeable loss caused by our failure to comply with these Terms using reasonable care and skill. We do not exclude liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• breaches of statutory rights applicable to digital content.

We do not accept liability for:

• business losses, loss of profit, goodwill, or data;
• indirect or consequential damages;
• problems arising from use of VPNs, unauthorized third-party tools, or hardware incompatibility.

Our maximum liability is limited to the value paid for the relevant Product.

13. Events Outside Our Control

We are not liable for non-performance due to events beyond our reasonable control, such as natural disasters, internet outages, civil unrest, or legal changes.

If such an event continues for more than 30 days, you may cancel the affected contract and receive a refund for unfulfilled Products.

14. Termination

We may suspend or terminate access to the Service without notice if:

• you breach these Terms;
• you fail to make timely payment;
• we are legally required to restrict your access.

You may terminate by ceasing to use the Service and deleting all installed Products.

15. Game Ownership, Licensing, and EULA

BigBoxPlay acts as a digital reseller and does not own or develop the Games offered through its Service. All Games are supplied by third-party developers or publishers (Publishers) and are subject to their respective licensing terms.

By purchasing, downloading, installing, or using a Game through the Service, you acknowledge and agree to be bound by the applicable Game EULA.

Games purchased through the Service are copyright works of the third-party developer or Publisher identified in the Game or its licensors.

Use of the Game is governed by the terms of its EULA unless you are presented with an alternative license agreement. If you purchase or download a Game and are subsequently presented with an alternative EULA that you do not accept and have not yet used the Game, you may contact support@BigBoxPlay.com. In such cases, BigBoxPlay may, at its discretion, cancel your purchase and issue a refund or account credit.

Each Game is licensed to you for personal, non-commercial use only. Unauthorized reproduction, modification, or redistribution is strictly prohibited. The Game may also provide access to additional online services, which are likewise subject to the Game EULA.

Limited Use License

By installing or accessing a Game, you are granted a limited, non-exclusive license to install and use a single copy on one compatible device, for your personal and non-commercial use, in accordance with the applicable EULA.

End User Rights and Obligations

The Game is licensed as a single unit. You may not separate its components for use on multiple devices. You should regularly back up your saved data. BigBoxPlay and the Publisher are not responsible for lost or corrupted data.

You may make one backup copy of the Game for personal use. You may transfer the Game to another device you own, provided you delete it from the original device.

You may not:

• sell, distribute, or transfer copies to third parties except via trade-in to BigBoxPlay;
• reverse engineer, disassemble, decompile, or derive source code (except where legally permitted);
• remove or alter proprietary notices or copy protection measures;
• use the Game for commercial purposes (e.g., in public venues or cafes);
• install or use the Game on more than one device simultaneously;
• export or re-export the Game in violation of applicable export control laws;
• create unauthorized derivative works;
• violate the EULA or any applicable laws in connection with Game use.

Ownership

The Game is licensed, not sold. You do not acquire ownership of the Game. All rights, including copyrights, trademarks, database rights, patents, and trade secrets, remain the property of the Publisher or its licensors. The Game is protected by applicable intellectual property laws and international treaties.

Some Game content may include licensed third-party assets. Those licensors may enforce their rights directly against you in the event of a breach.

Termination of License

Your license automatically terminates if you breach the EULA. Upon termination, you must immediately delete the Game and all copies. You may also voluntarily terminate the license by removing and destroying all instances of the Game.

Liability under the EULA

Nothing in this EULA limits consumer rights that cannot be excluded by law, or liability for death, personal injury, or fraud.

You use the Game at your own risk. The Game is provided “as is,” without warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

BigBoxPlay and its licensors do not warrant that the Game will be error-free or that defects will be corrected.

To the maximum extent permitted by law, BigBoxPlay and its licensors disclaim all liability for:

• loss of profits, business, or data;
• indirect, special, or consequential damages;
• errors or deficiencies in the Game;
• device or digital content damage unless caused by our failure to exercise reasonable care and skill;
• any modification, misuse, or unauthorized use of the Game by you or others.

Your sole remedy for dissatisfaction with a Game is to uninstall it and, where applicable, request a refund under our refund policy.

16. Privacy and Cookies

We process your data in accordance with our Privacy Policy By using the Service, you consent to our data practices, including:

• data collection and usage;
• use of cookies for personalization and analytics;
• your right to access, correct, or delete your personal data.

17. Health and Safety

Some Games may contain flashing images or intense visuals. If you experience nausea, dizziness, or discomfort, stop using the Game immediately. Always:

• take regular breaks;
• play in a well-lit room;
• maintain a safe distance from screens.

Parents should supervise children’s use of Games and seek medical advice if adverse effects occur.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Singapore. Disputes will be resolved exclusively by the courts of Singapore unless mandatory local consumer law provides otherwise.

These Terms represent the entire agreement between you and BigBoxPlay. Any failure to enforce a provision shall not constitute a waiver. If a clause is found unenforceable, it will not affect the remainder of the Terms.
